Court docs: “Jacob please don’t,” man charged in Fort Wayne Christmas Eve shooting

FORT WAYNE, Ind. (WANE) Police have identified a 34-year-old man charged in the Christmas Eve death of a woman at a home on Lafayette Street.

Jacob Chacon is charged with murder for the death of Brittany N. Deck, 30, of Fort Wayne. He was booked into the Allen County Jail at 1:40 a.m. Christmas morning, according to the website Mobile Patrol and the Allen County Jail.

Sunday, the Allen County Coroner ruled Deck died from a gunshot wound to the head and she is the 47th homicide in Allen County this year.

Court documents show Chacon was shown photographic evidence of an affair between Deck and one of his friends. He learned the news while at work and waited to talk his girlfriend when he arrived home at 4 p.m.

The probable cause affidavit reads he arrived home and confronted Deck but left after the argument. The woman left the home because she was in fear for her safety and picked up an unnamed witness, bringing them back to the home.

Around 6 p.m., Chacon arrived back at the home and was verbally insulting and berating Deck about the affair, court documents say. During the altercation, he threw a neck brace at her, striking her in the face. Chacon then went upstairs and started throwing all of her belongings out of the second story window.

Deck then went upstairs to talk with the suspect according to the probable cause affidavit. She heard him talking on the phone to someone and asked the unnamed witness: “What if he shoots me?” She ultimately decided to go upstairs to listen to his phone conversation.

Court documents say, shortly after the unnamed witness says they heard Chacon screaming and yelling profanities at Deck. Then the witness heard her say: “Jacob please don’t” followed by a single gunshot followed by Chacon saying “baby no, baby no”.

The probable cause affidavit reads the witness ran upstairs after hearing the gun shot and saw Deck bleeding and falling into Chacon’s arms. He then panicked and ran downstairs. Chacon then told the witness to call 911 before saying goodbye. Two children were in the home at the time of the incident.

Officers were called to the residence at 9 p.m., after a caller said a woman had died there. Officers found Deck suffering from life threatening injuries. Paramedics attempted to save her life, but she was declared dead at the scene, according to a release from the Fort Wayne Police Department.

Chacon is being held without bail at the jail and was in court hearing Monday. He’s scheduled to be back in court in January. Chacon is facing one felony charge of murder.
