STEUBEN COUNTY, Ind. (WANE) A Steuben County man is being held on a preliminary charge of murder in the death of his father. The body of Rusty Smith, 51, was found Wednesday afternoon in the road in front of a home near Orland Road.

Police were called around 12:35 p.m. to a home at 5325 West 400 North after a passerby reported finding the man down in the roadway. Steuben County Sheriff’s Department Chief Deputy Rodney Robinson told NewsChannel 15 the man’s body was found in front of his home – a white, two-story farm home with a red pickup alongside.

Crime scene tape was draped around the home and police could be seen investigating near a single-story home just down the roadway.

Police arrested 25-year-old Cody Smith later Wednesday afternoon.

Witnesses told police that Cody Smith fled from the scene in a silver Honda with a woman, 24-year-old Carley Carter, and her infant child. After more than two hours, around 3:20 p.m., the three were found at a home on West Nevada Mills Road near Jimmerson Lake, about four miles away.

Cody Smith is being held without bond at the Steuben County Jail. Carter was released and is not facing charges at this time.

The baby was also found at the home, unharmed, Steuben County Sheriff Tim Troyer said.
