FORT WAYNE, Ind. (WANE) - Allen County Superior Judge Ken Scheibenberger will stay on the ballot.
Thursday afternoon, the four member state Election Commission denied a motion to remove Scheibenberger from the November ballot because of previous disciplinary issues.
The motion cited a prerequisite under Indiana law that says a candidate for judge cannot have had "any disciplinary sanction imposed by the Supreme Court Disciplinary Commission".
Back in 2007, he was suspended for three days after he walked into walked into another judge's courtroom, wearing his black judicial robe and berated an accused drug dealer.
Scheibenberger believed that dealer had sold drugs to his 27-year-old son, who died from a cocaine overdose.
Scheibenberger is being challenged by attorneys Wendy Davis and Lewis Griffin on the November 2 ballot.
