Shooting fireworks off in Allen County without permit is illegal

FORT WAYNE, Ind. (WANE) - If you have plans to shoot off your own fireworks for the fourth, you might want to think again. With our dry conditions and a burn ban in place, the State Fire Marshal is encouraging folks to be safe over the holiday.

We spoke with the Fire Marshal and County Prosecutor Tuesday and if you're caught setting off fireworks in Allen County, you could face jail time.

"You can buy them. You cannot use them," Allen County Prosecutor Karen Richards said.

With the fourth of July right around the corner, some folks are still confused whether they can or cannot set off fireworks. The Allen County Prosecutor, Karen Richards, was able to clear up the confusion.

"You absolutely, positively cannot under any circumstances use fireworks in Allen County period."

The State Fire Marshal said with our dry conditions, even tossing out cigarette butts can be dangerous.

Not only is it dangerous for your family and neighbors, but also for the firefighters who have to battle the blaze.

"The equipment these firefighters wear encapsulates those to protect them from the fire. But in these conditions, heat exhaustion and heat stroke is very possible in these situations. So, that's why we ask the public to cooperate with burn bans with fireworks bans," Indiana State Fire Marshal James Greeson said.

The only way you can set off fireworks legally is if you obtain a state permit through the State Fire Marshal's office. For example, the Fort Wayne Tincaps and IPFW can set them off legally on the fourth.

If you get caught setting off your own, Richards said you'll be facing a Class B misdemeanor.

"Class B misdemeanors are enforced with a penalty of 180 days in jail and a $1,000 fine. They have already to my understanding made arrests. So, this is not something you're going to stand in your driveway, set off and get away with," Richards said.

If the jail time and fine don't deter you from setting of fireworks, the Fire Marshal said you will also be liable for any damages or injuries.

Families are invited to watch the fireworks display at IPFW. Professionals there have obtained a permit from the State Fire Marshal's Office. They will have firefighters on scene to help with any issues. The show starts at 10:15 p.m.
