Officer justified in fatal shooting

FORT WAYNE, Ind. (WANE) - The Allen County Prosecutor announced Monday the officer who shot and killed a man on Greene St. was justified in using deadly force.

On April 9, officers were serving a Failure to Appear warrant on 26-year-old Marcus Hayden.

When police entered the apartment, Hayden shot at them. A U.S. deputy marshal was hit in the leg.

Hayden jumped out of a window and tried to get away. He also refused to drop the gun he had. That's when Officer Derrick Demorest shot him.

The prosecutor released a statement Monday saying no charges will be filed as a result of the shooting because Demorest was justified in using deadly force.

This investigation was completed by the Fort Wayne Police Department and the Indiana State Police.
