FORT WAYNE, Ind. (WANE) A Michigan law firm has filed a class action lawsuit against Kroger on behalf of all customers who bought pet food that was recalled in December of 2010.
At that time, Kroger issued the recall of 68,313 bags of pet food because of possible Aflatoxin contamination. Aflatoxin is a toxic by-product of the growth of mold and fungi on corn and when ingested by pets can cause lethargy, anorexia, vomiting, bloody diarrhea, and liver disease.
The lead plaintiffs in the suit, which was filed by Macuga, Liddle & Dublin, P.C. in Detroit, said they fed Kroger's Old Yeller Chunk Dog Food to their pedigreed German Shepherd. In January 2011, the dog got sick and later died.
The recalled Kroger pet foods were sold in stores in Indiana and Ohio as well as Alabama, Arkansas, Georgia, Illinois, Kentucky, Louisiana, Michigan, Mississippi, Missouri, North Carolina, South Carolina, Tennessee, Texas Virginia, and West Virginia.
