The plaintiff challenged the constitutionality of the statute. Chief Judge Philip Simon of the U.S. District Court for the Northern District of Indiana granted the State defendants’ motion to dismiss the plaintiffs’ amended complaint and entered judgment in favor of the State and against the plaintiffs.
Indiana Attorney General Greg Zoeller’s office defended the Right to Work Statute and issued the following statement after the decision to dismiss:
“The federal court’s decision supports the legal authority and policy decisions of the people’s elected representatives in the Legislature, and we appreciate the court’s thorough analysis. My office will continue to defend the statute from legal challenge or appeal in any future court action.”
