Delagrange probable cause affidavit

The following is the probable cause affidavit filed in Marion County, Indiana in connection with the arrest of David Delagrange:

On 2-27-10 Melissa Sagovac, a manger at Vanity clothing store, noticed a w/m later id’d as David Delagrange DOB 7-9-69 following one of her employees, KV w/f/17. She stated that she noticed that he was acting weird and getting real close to her. This happened multiple times and it made Ms. V very uncomfortable. Ms. Sagovac called the off duty IMPD officer working at Castleton square mall and Officer Brian Silcox responded. Upon his arrival Mr. Delagrange had all ready left the store but Ms. Sagovac gave Offc Silcox a very detailed description. Officer Silcox was able to see Mr. Delagrange inside the Forever 21 store. He went and got Ms. Sagovac and brought her to the store window and she immediately stated that the person inside the store was the man that was following her employees. As officer Silcox approached him he noticed that Mr. Delagrange’s right foot was in between a female’s leg as she had her back to him. Officer Silcox, who was in full uniform, asked Mr. Delagrange what he was doing and he turned around visibly startled and started to walk away briskly. Officer Silcox grabbed Mr. Delagrange by the arm and told him to stop. Mr. Delagrange forcibly pulled his arm away from officer Silcox and took a defensive stance posturing like he was going to fight Officer Silcox. Once again officer Silcox grabbed his arm and told him to place it behind his back. Mr. Delagrange once again pulled away, officer Silcox pulled out his taser and tased Mr. Delagrange twice. Mr. Delagrange was placed under arrest and sat in the hallway of the mall. While sitting there Officer Silcox saw a sophisticated camera system that was attached to Mr. Delagranges right boot. When I arrived on scene I talked to Ms. V who stated that Mr. Delagrange was following her around the Vanity store and getting uncomfortably close to her from behind. I was then given video from the Vanity store that showed Mr. Delagrange following her around the store. Detective Kurt Spivey arrived on scene and assisted me in writing search warrants for Mr. Delagrange’s home in Ft. Wayne and his car that was towed to a secure site. Det. Spivey and I went to Ft. Wayne and executed the signed search warrant on his residence.

 

On 2-28-10 I went back to Castleton square mall after getting a call from Von Maur stating that they had an employee who was photographed unbeknown to her. They stated that they had CCTV video of Mr. Delagrange walking up behind Joy Corpuz and sliding his right foot under her dress. I talked to Ms. Corpuz and she stated that she was working in the cosmetic section on 2-27 and was told by another employee that “this creepy white guy was standing behind her smelling her hair.” Ms. Corpuz told me that she noticed Mr. Delagrange come in but did not know that he was standing behind her or putting his foot between her legs.

 

I served a signed search warrant on Mr. Delagrange’s car and confiscated numerous items.
On 3-2 Detective Matt Shores from the Cyber Crimes unit picked up all the evidence from the property room

and analyzed it. He was able to provide me with a video of everything that was on Mr. Delagrange’s camera.

 

On 3-2 I met with TG w/f/17 and CB w/f/17 who told me that they were at Castleton square mall on 2-27 and were followed by Mr. Delagrange. They both stated that they were inside Forever 21 when he first approached Ms. G who was wearing a jean skirt with safety pins in it. Ms. G stated that he got uncomfortably close to her on several occasions. She stated that at least two times he came up from behind her getting less than a foot away. Ms. B stated the same thing, that Mr. Delagrange was also following her around and getting less than a foot away from her. She stated that she was wearing a jean skirt with a design on the pocket. I showed Ms. G video of what appeared to be a female in a jean skirt and she immediately started crying and stated “yes that’s me.” I asked how she knew it was her and she stated, “that’s my jean skirt with the safety pins, the bracelets I was wearing and the exact same finger nail polish.” I showed Ms. B a picture of a female in a jean skirt and she immediately stated that was her. She stated that the skirt was exactly the one she had and she knew it because of the design on the pocket. She also could see the back of her head and told me that, it was her hair and shirt she was wearing. Both Ms. G and Ms. B came forward after seeing Mr. Delagrange’s picture on the news and watching the story. They stated that as soon as they saw his picture they knew he was the guy that was following them.

 

On 3-2 I interviewed AK w/f/15 who stated that she was in Castleton square mall on 2-27-10. She stated that she was with her mom and dad and went to the Aeropostle store where a w/m later id’d as Mr. Delagrange started following her. She stated that at first he was getting very close

to her, so close that she could feel him breathing on her and believes that one time his belly rubbed up against her back. She went from the back of the store to the front of the store where her mom was standing then to the back of the store again and the whole time he followed her very closely. Ms. K told me that she was wearing a black dress, with black boots. I showed her video of a female in a black dress with black boots and she immediately stated that it was her. She stated she knew it was her because in several of the shots you could see her mothers very unique Vera Bradley plaid tweed purse in the background. Ms. Jamey Knight, who was with her daughter showed me the purse and it did indeed match the video. Ms. Jamey Knight told me that she contacted me after seeing the story on the news and knew that the man that was arrested was the same man that was following her daughter on 2-27. Ms. AK also stated that she was 110 percent sure that the man in the story was the one that had followed her.

 

On 3-2 I interviewed Clair Schlaer and Sarah Stephenson who both work at Limited in Castleton Square mall. They contacted me after seeing the story in the news and remembering that Mr. Delagrange was in their store on 2-27 and following them around. Ms. Schlaer stated that Mr. Delagrange followed her around for over 20 minutes, and at one point she turned around and tripped over his foot that was between her legs. She stated that he was very close to her on numerous occasions. I showed her video of a female in an orange dress and Ms. Schlaer stated that was indeed her. There was so much video of Ms. Schlaer that on several occasions you can even see her face. Ms. Stephenson stated that she also was followed around the store by Mr. Delagrange. I showed her video that appeared to be the same store of the video that Ms. Schlaer was in and in between different videos of Ms. Schlaer. It showed a female in a green dress with a gray sweater, and Ms. Stephenson stated that was her. She recognized what she was wearing and the same hair styles.

 

On 3-2 I showed Ms. V video of a female in a silky black skirt and she stated that was her and the same skirt that she was wearing that night.

 

Mr. Delagrange was arrested on 2-27 and transported to the APC by MCSD wagon. His pants, shoes and camera system were removed and placed in the property room as evidence. All events occurred in Marion County.
