Convicted rapist accused of same crime again

GREENWOOD, Ind. (AP) -- A convicted rapist who was released earlier this year after serving less than half his prison sentence was charged Monday with sexually assaulting a Greenwood woman in her apartment while her 1-year-old daughter slept nearby.

Shawn L. Corbally, of Indianapolis, is charged with four counts of rape and five counts of criminal deviate sexual conduct in the July 29 attack. Johnson County Prosecutor Brad Cooper also charged the 33-year-old Corbally with six other felony counts, including confinement, intimidation, burglary and failure to register as a sex offender.

Corbally was being held without bond in the Johnson County Jail and he had no court appearances scheduled. The prosecutor's office said it didn't know if he had an attorney.

Corbally was arrested July 31, a week after he was released from jail following his arrest in a separate attack.

In that case, a 57-year-old woman told police she had been assaulted in an apartment building laundry room. Indianapolis police arrested Corbally on July 21 on preliminary charges of sexual battery, criminal confinement and strangulation, but he was released three days later after prosecutors said evidence problems made it impossible to press charges.

The Indianapolis Star reported Sunday that police could have kept Corbally in jail on charges of failing to register as a sex offender within 72 hours of moving from Clinton County to Indianapolis, but no charges were filed.

Prosecutors allege that Corbally attacked the Greenwood mother five days later in an assault that ended only after a witness saw Corbally leading the naked woman outside of her apartment. The victim told police she was sleeping with her daughter when she awoke to find a knife-wielding man on top of her. She said the man threatened to kill her daughter and her 9-year-old son, who was in another room, and that he raped her repeatedly.

Police say the victim positively identified Corbally from a photo lineup.

Corbally was released from prison in February after serving less than 12 years of a 25-year sentence for a September 2000 rape conviction. Upon his release, he was designated a "sexually violent predator" and was placed on five years' probation, The Star reported.

He moved to Clinton County to live with his sister and was required to register with the Clinton County sheriff's office every 90 days. Sheriff's officials were to visit him once every 90 days to make sure he was living where he said he was.

Corbally re-registered in mid-May, and sheriff's officials visited him at the end of that month. He wasn't due for another visit by deputies until this month.

The sheriff's department believes he moved to Indianapolis to live with his mother in June.

A woman who answered the phone at the listing for Corbally's mother declined to comment Monday when contacted by The Associated Press.

Indiana Department of Correction spokesman Doug Garrison said Corbally got his sentence reduced through good behavior, earning his GED and participating in vocational training and substance abuse counseling. Indiana prison inmates generally receive a day's credit for every day served with good behavior.
